1 Acceptance of Terms

By accessing or using this Website and our Easy Haul software services, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use this Website or our software services.

This Website and software is owned and operated by Civil & Mining Automations (ABN 91 690 569 816), operated by Duan Jordaan (referred to as we, us, our).

2 Software Services

We provide Easy Haul, a GPS-based load tracking system for haul trucks used in mining rehabilitation and civil construction projects.

2.1 Licensing Model

Easy Haul uses a subscription-based licensing model where each active vehicle/tablet consumes one software licence. Pricing is customised based on fleet size and project requirements.

2.2 Services Included

  • Project setup and configuration including DXF file processing
  • GPS-based zone detection and load tracking via tablet application
  • Offline-first operation with automatic data synchronisation
  • Web portal access for data viewing and export
  • Technical support and system updates

3 Subscription and Licensing

Software licenses are provided on a subscription basis according to the terms agreed in your licensing agreement.

  • Each tablet device assigned to a vehicle requires an active licence.
  • Licences are managed through the web portal by authorised administrators.
  • Subscription terms, pricing, and payment schedules are defined in your custom licensing agreement.
  • You may cancel your subscription according to the terms in your licensing agreement by contacting us.

4 Data Collection and Use

The Easy Haul system collects operational data including:

  • GPS coordinates for zone detection and location tracking
  • Operator names and shift information
  • Vehicle identifiers and service metre readings
  • Load and dump records including material types and tonnages
  • Timestamps for all recorded events

Your Data: This data is collected for the purpose of providing the service and is handled in accordance with our Privacy Policy. You retain ownership of your operational data and may export it at any time.

5 User Obligations

You must not:

  • (a) Copy, reproduce, reverse engineer, or modify any part of the software or its code without permission.
  • (b) Use the software for purposes other than haul truck operations and material tracking.
  • (c) Engage in illegal, fraudulent, or disruptive activities using the software.
  • (d) Share login credentials or allow unauthorised access to the system.
  • (e) Attempt to interfere with security, access other users' data, or disrupt system operations.
  • (f) Remove or tamper with tablet devices assigned to vehicles.

You are responsible for ensuring operators use the system correctly and maintain the security of tablet devices.

6 Intellectual Property

All software code, documentation, designs, and system components remain our property or that of our licensors. You receive a limited licence to use the software for its intended purpose during your subscription period.

DXF files and operational data you upload remain your property. You grant us permission to process this data to provide the service.

7 Offline Operation and Data Synchronisation

The Easy Haul tablet application is designed for offline-first operation, allowing continued use without internet connectivity for up to 30 days.

  • Data captured offline is stored locally on the tablet and synchronised automatically when connectivity is restored.
  • We are not responsible for data loss if tablets are damaged or fail before synchronisation occurs.
  • You should ensure tablets are connected periodically to synchronise data and receive system updates.

8 Privacy and Data Protection

We collect and handle your personal information in accordance with our Privacy Policy (accessible here). By using our services, you consent to the collection and use of your data to provide and manage the software, including GPS location tracking, shift data capture, and communications related to your account.

9 Service Availability and Updates

We strive to maintain service availability but cannot guarantee uninterrupted access. We may perform maintenance, updates, or improvements that temporarily affect service availability.

We may update the software from time to time to improve functionality, fix issues, or add features. Major changes that affect core functionality will be communicated in advance where possible.

10 Limitation of Liability

To the extent permitted by law:

  • We exclude all liability for loss or damage from use of the software or services, including but not limited to data loss, business interruption, or operational delays.
  • We are not responsible for errors in data entry by operators or inaccuracies in GPS positioning due to environmental factors or device limitations.
  • Nothing in these Terms excludes any rights you may have under the Australian Consumer Law, including guarantees that cannot be excluded.

11 Refunds and Consumer Guarantees

We comply with the Australian Consumer Law (ACL). You are entitled to a refund or remedy if our services are not provided with due care and skill, are unfit for purpose, or do not match the description.

Refund policies for subscription fees are defined in your licensing agreement.

If you believe you are entitled to a refund under the ACL, please contact us using the contact form on our website.

13 Termination

Either party may terminate the licensing agreement according to the terms defined in your agreement. Upon termination:

  • Your access to the software and web portal will be disabled.
  • You may export your operational data within a reasonable period before termination.
  • Tablet devices must be returned if they are our property, as specified in your agreement.

We may suspend or terminate your access immediately if you breach these Terms or engage in misuse of the system.

14 Changes to Terms and Services

We may update these Terms from time to time. Significant changes will be notified to you in advance where possible, allowing you to review and contact us if you do not agree to the updated terms.

15 Governing Law

These Terms are governed by the laws of Western Australia, Australia, and disputes will be subject to the jurisdiction of its courts.

17 Definitions

In these Terms:
"Easy Haul" refers to our GPS-based load tracking software for haul trucks.
"Tablet" refers to Android tablet devices running the Easy Haul application.
"DXF file" refers to georeferenced site plan files in DXF format.
"Zone" refers to geographical areas defined by polygons in DXF files.
"Operator" refers to haul truck operators using the system.
"Web Portal" refers to the web-based administration interface.
